General conditions MEACITY

MEACITY is a chat - and datingfaciliteit which is accessible for members by means of Internet and in the near future by Telephone. By registration as a member for both chatting as well as for the dating at MEACITY you accept the general conditions of MEACITY and commit yourself to a legal agreement with MEACITY B.V. If you don’t agree with the general conditions registrating is not possible.

Article 1. Definitions
MEACITY is in general free for chatting and dating, however for additional services / applications a monthly contribution is required.

1. sub 1. The free and paid facilities can be adapted periodically depending on what MEACITY considers to be desirable. Also the monthly compensations can be adapted for this additionally.

1. sub 2. If one does not stick to the directives of MEACITY, MEACITY is entitled to block, deny or refuse access to all or some facilities. Already paid contributions or compensations are never returned in that case.

Article 2. Access and recording
For dating at MEACITY a member must be at least 18 years and fill in all obligatory fields of the registration form. For chatting it is considered that each member has a minimum age of 12 years. MEACITY is not responsibly if one doesn’t stick to the age limits to become a member and regardless of this obligation still registrates as a member and due to this, experiences damage or uncomfortable situations.

Due to the limits of MEACITY on which the identity of the members can be checked, the member protects MEACITY acceptance of these general conditions of all possible liabilities regarding to the incorrect age and also for each liabilities if the identity of member is used by someone else. Should a member suspect incorrect or unauthorized use of its data then this member is obliged to indicate this directly to MEACITY in order to give MEACITY the opportunity to react adequate to this misbehavior and take proper measures.

2. sub 1. Transferability data
Each membership at MEACITY, irrespective of whether this membership is free or not, is personally and not transmissible.

2. sub 2. Liability data
After registration each member receives its own registration code and password. These are considered to be treated personally and confidentially and therefore not transmissible to third parties. MEACITY accepts no liability for the loss of the registration code and or password by the member. Also MEACITY is not responsible for abuse of the data supplied by the member. Each member carries themselves their own responsibility for a correct use of the data received. The member is fully responsible for use of its data whether used in a correct way or not.

By acceptance of the general conditions the member agrees not to hold MEACITY responsible for each liability regarding to data supplied by him or by others who uses his or hers data regardless whether this is been used in a sincere way or not.  

2. sub 3. MEACITY is at all times authorized to refuse members, without refusing statement of reasons.

2. sub 4. Access to the Internet site and services
The member must have knowledge of the hardware and software which is required for working with Internet, or similar applications or with Internet services. Also the member must recognize that by the use of tel. services, audio services and the properties of it, as well as the restrictions of the Internet it is not possible to give guarantees on the security, availability and integrity of dataprocessing by means of the Internet.
In order to be able to use the services of MEACITY in a proper way, the member must have suitable hardware, software and parameters which make it possible to access and use MEACITY. MEACITY is not obliged to modify or program its Internet site so that it is possible for each member and/or visitor to access the Internet site and use its functionalities and services optimally.

Article 3. Directives
It is prohibited to use MEACITY in any way in an unlawful manner or to use MEACITY for purposes which not apply to the directives of MEACITY, or cause indictable offenses which are not in line with standards commonly applying and values and/or directives of MEACITY.

3. sub 1. For use of MEACITY the following directives are in order:
• It is prohibited by all means to spread information visible on MEACITY in any way, both directly as well as indirect, without written authorization of people concerned. People concerned can be both employees of MEACITY be as well as members or visitors of the Internet site of MEACITY.
• Use of data and images on MEACITY for unlawful and/or detrimental aims are strictly prohibited.
• Violation on the privacy of third parties is not permitted. This includes spreading received (private) messages, photograph(s), images or flirts without authorization of the ones concerned.
• Usage of embarrassing texts or images, racist expressions, pornographic texts or  images, religious offending, offending judgments, detrimental software, spreading of secret or confidential information of third parties and all remaining detrimental texts, images or what so ever are strictly prohibited.
• Unauthorized use of all data available on MEACITY is prohibited and will be treated as a violation of the privacy of the concerned ones and therefore will be reported to the police.  

3. sub 2.  By accepting the general conditions each member declares that personal details of third parties, on which the member has access to by using MEACITY, will not be using these details for aims regarding to mailings or other commercial as well as non- commercial actions. Each member agrees by excepting the general conditions not to send junkmail, spam, collar letters, mailing or correspondence which could be seen as disturbing to the receiver to whether these are actual members or previous members.  

3. sub 3.  Also each member agrees not to annoy other members by continuously sending emails to others should they have indicated not to prefer further correspondence. Also if a member indicates nothing at all or doesn’t respond in any way to interest from your part,  repeatedly contacting this member can and will be seen as scamming and MEACITY will use her privilege to end your membership without further notice or without obligation to explain why these actions have been taken.

3. sub 4. Correspondence from both sides is being considered to be conducted in a neat and not-embarrassing manner towards each other. Should there be obscene language involved MEACITY is entitled to end the membership without further notice or without obligation to explain why these actions have been taken.
MEACITY is, in order to maintain quality in communication and approach between members entitled to view and check all profiles, if necessary recall correspondence, modify or remove the correspondence and privileges of the member without statement of reasons or justification to the member.

3. sub 5. Registration is only prohibited for one time only in order to reduce unreliable membership amounts which are being correspondent to visitors of MEACITY.  If a person tries to get around this one-off registration by means of several accounts then this will be considered as a summary offense of the directives and preserves of MEACITY and will be therefore reported to the authorities.

3. sub 6. From the point of view of security and quality MEACITY will erase the accounts of members which have not been using the services during a minimum of six months regardless whether the member is registered as a Free or a Full member. This period of six months will start as from the last day of the visit of the member, therefore up to six months afterwards.

Article 4. Tariffs and payment conditions
All prices mentioned are including VAT.

4. sub 1. In case of an agreement on which a member has agreed that MEACITY has the authority to collect the contribution amounts automatically each period, MEACITY is authorized to modify or change each prizes by notification on the website or by sending an email with notification, or sending a letter by post regarding the new prices. Members have their own responsibility to view the actual prices mentioned on the website.  

4. sub 2.  In case a member doesn’t agrees with the changed prices and tariffs of the services of MEACITY, then the member entitled to cancel the agreement within 7 days starting from the date that the new prices would be effective.   Cancelling the membership is only prohibited by sending an email or by sending a letter to the administration of MEACITY. All invoices must be satisfied in accordance with the payment conditions mentioned on the invoice.

4. sub 3. Automatic payments which, within the agreed period are not paid by the member, will be increased with legal interest and will be handed over to a (debt-) collection agency. If the outstanding amount has been handed over to a (debt-) collection agency all additional costs, both judicial as well as extrajudicial and also administrative costs will be additionally charged to the member. The administrative costs will be stipulated at the moment the debt is offered to the agency.

4. sub 4.  If the member has chosen at registration for the option automatic lengthening, the membership will be extended automatically according to the same period, the same tariff and the payment method which has initially chosen by the member at registration. The member can suspend or conclude automatic lengthening at each moment whenever he or she considers this desirable. This suspension or concluding becomes in that case effective by the next due date of the membership.

4. sub 5.  Refund of once paid amounts is not possible, also not if one concludes the membership prematurely or wishes to conclude the membership for whatever reason. Also it is not possible to claim any damage suffered what so ever by using the website and services of MEACITY.  Usage of MEACITY and all its services is the full responsibility and own risk of the member or visitor of the website of MEACITY.

4. sub 6.  MEACITY offers the possibility to chatters and daters to purchase credits. With these credits one can buy virtual goods in 3D environment of MEACITY and can be virtually used. If one has bought virtual goods as a chatter or a dater for usage in the 3D environment of MEACITY these can not be exchange for the representing value which one paid to gain these credits. Also it is not permitted to transfer or sell virtually bought goods to other users or exchange credits with each other in or outside the 3D environment .

4. sub 7.  If a member wishes to no longer use the website of MEACITY and its services, all privileges and belongings of this member will expire.  Also the credits which belong to this member will no longer be valid and will be removed from the profile without any reduction or exchanging to the member for the representing value when these credits were bought.

Article 5. Privacy and protection
It is prohibited to place private data, email addresses, phone numbers, addresses, surnames, URL's, ICQ-numbers, or other remaining personally related information, on which members can contact each other outside MEACITY at ones profile. Also it is prohibited to request these kind of information to other visitors and members.

5. sub 1.  It is forbidden to place photographs of a sexual nature, or photographs which are considered intolerant by society , or are to the judgment of MEACITY incorrectly at the ones profile. MEACITY has the right , without pronouncing or justification to the member concerned, to remove  these photographs or images.

5. sub 2.  Profiles are being checked by MEACITY and will be removed or adapted, without statement of reasons or justification to the member, if these are by the judgment of MEACITY not appropriate in the policy of the website and the services related.

5. sub 3.  The information supplied by the member must be up-to-date and should contain correct information in order to prevent misleading of visitors and members of MEACITY. If it appears that the information is incorrect, for any reason what so ever , then MEACITY is entitled to remove this member form the website. For the record and as already mentioned before, once paid amounts will not be restituted.

5. sub 4.  The impact of publication of private data is exclusively the responsibility of the member concerned. The member takes the initiative to publication and distribution of personal information, data, text, contents, pictures and images ny using MEACITY. Because of this the member do distance all possible claims on MEACITY due to damage or other inconveniences experienced by the member, particularly on the basis of possible damage to the image, the reputation or the privacy of the member, originating from the distribution or publication of information on the member by means of the website of MEACITY.

5. sub 5.  MEACITY is only intended for interaction between visitors and members and therefore no consonance chalkboard for messages differently than permitted by MEACITY.  The aim of the website is to achieve communication and maybe possible friendships between visitors and members who visit the website. Specifically regarding the chat environment the possibility has been created to communicate with each other.

5. sub 6.  If the member or visitor spreads publicity messages or abuses MEACITY for other aims differently than for which these are meant the member will be removed directly without any refund of paid money. It has not been permitted to use MEACITY for offering products or for advertisement aims or other commercial aims differently than permitted by MEACITY. 

5. sub 7.  All communication mutual by members are considered as private and will not be made available for any kind of reason what so ever. However, MEACITY preserve the right to check the communication mutually with or without authorization of people concerned.

5. sub 8.  At registration all supplied data for Full members will be accessible except address data (if given) and birth date. However, at task of data the age will be calculated for the search profile option. MEACITY also preserve themselves the right for Free members or visitors to show this data if one considers this necessary. MEACITY is not responsibly if data and photographs of a member are incorrectly shown and as a result an incorrect picture arises at a possible interested in the profile of that concerning member.

5. sub 9.  All information in the personal recall, search criteria  and profile is accessible by means of the website of MEACITY and by means of email (newsletters). Moreover it is possible that this information will be used directly by MEACITY or by our partners in newsletters or on websites of third parties, electronic (e-mail, SMS, etc.) or audiovisual (radio, television, etc.), or by means of the written press (newspapers, illustrated magazines, etc.) or being sent to persons who are interested in MEACITY. By promotion of this personal recall, search criteria and profile the chance of meeting someone with common interests increases.

5. sub 10.  Provided information by the member can be used for the study of demographic data. These data reveal absolutely nothing concerning individual persons, but are related to joined information such as: how many men/women visit the site, in which age group the largest quantity visitors has been concentrated, which Article are most popular, etc. These data can be used by MEACITY to be made available for (commercial) third parties. By studying this information MEACITY is able to adapt the website and its functionalities more on the wishes of the members connected.

5. sub 11.  MEACITY has tried to protect the website as good as possible to make sure all data is stored in a safe surrounding.  Only a limited number of employees of MEACITY has access to the data to guarantee quality and abuse to prevent. Personal details which at the registration are supplied by members, other than in the personal recall, profile and photographs, are not accessible for third parties. Address data are only registered for payment obligations. Credit card data become as soon as there to payment has proceeded, entirely under banking secrecy treatment.

5. sub 12.  For security purposes the ip-adresse of the computer connection of each member will be stored by MEACITY. MEACITY preserve themselves the right for, in case of abuse, using the ip-adresse data to retrieve data regarding this member.

Article 6. Intellectual property
Each member agrees that without the explicit written authorization of MEACITY and of the owners of intellectual tenures he or she absolutely will not spread or publicize visible material, or modify material whether this in or without his or hers benefit, nor will he or she distribute or reproduce these tenures. This concerns among others photographs, profiles of members, article, recommendations and other remaining contents of the website of MEACITY.

6. sub 1.  MEACITY is authorized to use intellectual tenures on the contents of all profiles which have been supplied by members on the website of MEACITY. This applies in particular on the duplication and reflecting contents which members share on the website of MEACITY.  This authorization also concerns mailings and newsletters provided by MEACITY or corporations on which MEACITY has an agreement to distribute these contents.  MEACITY is also authorized to adapt all contents to the design of the website of MEACITY and/or its technical requirements.

6. sub 2.  The member supplies an unconditional permit to MEACITY on the use of all intellectual tenures on the contents supplied by the member and which MEACITY can and if necessary will use for spreading these contents on the website of MEACITY.

6. sub 3. The permission includes in particular the right for MEACITY to duplicate, reflect, adapt, modify, translate, scan, use for publicity aims both commercially and non-commercial, and also to provide permission regarding contents of members (information, photographs, video pictures, descriptions, search criteria, etc.) to other third parties by all means of MEACITY services (on the MEACITY website, by email and by all forms of audio) and/or in mailings which MEACITY sends. Also MEACITY is permitted to spread contents of members through all media distribution channels like for instance e-mail, SMS, MMS, WAP, Internet, CD-Rom or DVD-rom or audiovisual communication mediums like for instance press, radio, analog television, digital television, cable or satellite.

6. sub 4. The member gives MEACITY explicitly authorization to adapt these contents to at the latest MEACITY services and/or the other above-mentioned communication mediums, and/or to adapt these contents to the technical requirements or correct mediums classifications. It has been prohibited members contents which are related to other members, dupliceren or copy how thus to use differently than for the use of the services for the personal aims and privédoeleinden of the member themselves.

6. sub 5. The user priveliges which are granted by MEACITY to members, are strictly restricted to the use of these documents for private and personal aims within the framework and during the duration of the membership at MEACITY. All other use by members without explicit authorization of MEACITY is strictly prohibited.

6. sub 6. It is prohibited for members or visitors to modify, duplicate, copy or distribute the services or webpages of MEACITY. This also concerns the computer codes or elements from which the services of MEACITY have been built.

Article 7. Suspension
Each membership at MEACITY can be cancelled at each desired moment. If one wants to cancel, this can be done on the website of MEACITY or by sending an email or a cancellation letter by registered post.

7. sub 1. MEACITY is entitled to conclude each membership, other agreements or  propositions, legal mediations or other notifications with immediate entrance and/or refuse access to MEACITY entirely or partially, or temporarily to block each member if one or several obligations do not comply entirely with the regulations of MEACITY.

The membership can be concluded with immediate entrance as a result of for instance continuously , obviously founded, complaints concerning unpleasant or inacceptable chat/email behavior towards other members or lagging behind payments or attempts to transfer the membership to third parties.

7. sub 2. The member will be informed by email concerning, or receive an affirmative of the suppression of his or her account. Personal details of the member will be removed on its request or after the legally determined period which follows on the suppression of the account of the member.

7. sub 3. If MEACITY can be accounted for a shortcoming for a period longer than a month and therefore can no longer comply to its obligations both MEACITY and the member are prohibited to cancel the agreement.

Article 8. Liability and guarantee
Offers made on the website of MEACITY can not be placed under the responsibility of MEACITY and therefore no rights towards MEACITY can be justified.  MEACITY protects itself from claims or other liabilities and by accepting the general agreements each member agrees to this protection.

8. sub 1.  MEACITY is never responsible for any damage, whether this is emotional damage, physical damage, intellectual damage, damage to equipment, damage to computers, damage to the software of the computer or other all remaining damage created by usage or visiting the website of MEACITY. Usage or visiting of the website of MEACITY is and remains for all times at own risk.

8. sub 2.  MEACITY can never be hold responsible for expectations by means of satisfaction. Guarantees regarding friendships, partners, chat- and email friends, and all remaining expectations do not fall under the responsibility of MEACITY. Also MEACITY cannot be blamed if there should be negative aspects in ones relation - and in friendships due to the use of and/or visit to the website and services of MEACITY. Unpleasant behavior and parlance by members are outside the responsibility of MEACITY.

 

8. sub 3.  It is possible that by certain provided data, comments, contents (photographs and video pictures), justifications or initiatives by members their ethnic source, nationality, religion and/or sexual preference are visible to others.  By supplying such, entirely optional, information the member shows his or her intention and therefore explicitly agrees not to hold MEACITY responsible for the processing of these sensitive data by MEACITY. The member accepts explicitly its own responsibility.

  

8. sub 4.  MEACITY is never responsible for incorrect declarations which have been done by members. If one decides to a meeting by usage of MEACITY this is entirely the full responsibility of the member and at own risk. It is important that each member realizes himself, before agreeing with a meeting risks are being taken.  MEACITY can bear no responsibility for this, the justification lies at the member themselves. Moreover, for each first appointment MEACITY would advisable to inform someone in the surroundings about the meeting and also to plan this meeting in a public environment (bar, bar, restaurant etc.)

Regarding this MEACITY again advises its members not to place private data (such as surname, (e-mail) address or phone number) on ones profile on which other members can try to locate or Identify the member involved.

8. sub 5.  MEACITY does everything to let function to the Internet site optimally. In spite of these efforts no rights can be linked be put and cannot MEACITY responsible if at some moment no optimum functioning of the site is experienced. Jammings and such are tried to be as soon as possible solved and do not fall under only guarantee where towards MEACITY rights to are able be linked. MEACITY cannot guarantee that the service will not be interrupted by jammings. MEACITY make efforts to remedy failures in the service as soon as possible. MEACITY cannot be put responsible for the distribution of some information infected with virus.

8. sub 6.  MEACITY uses cookies on which data is being stored from the members during their membership on MEACITY. Because of this members can use the website without interruptions or without typing all kind of information always on each page. Members, which do not want that cookies are being used, can adapt the options concerned in the Internet browser.

8. sub 7. MEACITY cannot be hold responsible for any indirect damage, continuation damage included, nor can MEACITY be hold responsible for damage to companies, loss of income, damage as a result of errors on the internet, damage raised by leaking of confidential information,  damage by electronic errors or damage as a result of revendications of third parties towards the members of MEACITY.

8. sub 8.  By acceptance of these conditions the members and visitors protect MEACITY  for all revendications of third parties which are related to the use of the services of MEACITY by members, and/or insufficient compliance by members resulting in obligations towards MEACITY from these general conditions.

Impact of shortcoming in the compliance with MEACITY towards third parties, which are caused by or because of behavior of members are always for account and risk of the concerning member.

MEACITY cannot be hold responsible for the impact of actions of third parties which provide themselves access to the site, mail bulletins or information of members and make changes in the available information.

Article 9. Final provisions
Should MEACITY decides to corporate with another party, or is taken over or another form of cooperation then all rights and obligations between the member and MEACITY proceed in these new form of cooperation without required authorization of this fact of the member in advance and afterwards.

9. sub 1. Should it appear that an article, sub article or component in these general conditions is void, then all remaining other articles, sub articles or components are still valid. A new acceptation therefore of the general conditions without this invalid condition is not necessary and is considered again approved by each member. All conditions if the general agreement are under Dutch law. Disputes between members and MEACITY are made pending at the competent judge in Amsterdam; or, by choice of MEACITY, at the competent judge of another place of residence.

9. sub 2. If the general conditions are violated or are been recognized by any member, MEACITY is then entitled to remove the member directly from its website and database. If a member or visitor does not understand some article or directive of the general conditions and still accepts the general conditions, no rights can be demand by this member or visitor.  Acceptance of the general conditions implies also that one has understood all articles and sub articles and therefore also agrees on all conditions mentioned.
 
9. sub 3. MEACITY is entitled to make modifications of the general conditions and/or directives without notification of all members in advance. Also MEACITY is not obligated to notify modifications of the general conditions and/or directives afterwards to all members or visitors.  Both, visitors and members must themselves take notice on a regular scale regarding the topicality of the general conditions.
